Treasure Chest Games offers this website, including all information, products, services, and features available through this site, conditioned upon your acceptance of these Terms of Service.

By visiting our website, purchasing from us, creating an account, or otherwise using our services, you agree to be bound by these Terms of Service and any additional policies referenced or linked on our website.

If you do not agree to these Terms of Service, you should not use this website or purchase products or services from us.

1. Online Store Terms

You may not use our products, website, or services for any unlawful or unauthorized purpose.

You may not transmit viruses, malicious code, or other material designed to interfere with the operation or security of our website.

We reserve the right to refuse service, cancel transactions, or restrict access to our services where reasonably necessary, including in cases of suspected fraud, abuse, unauthorized activity, pricing errors, or violations of these Terms.

2. Products and Availability

We make reasonable efforts to accurately display and describe the products available through our store.

Many of the products sold by Treasure Chest Games are collectible, pre-owned, vintage, limited-release, or otherwise unique. Product availability may change quickly, and inventory displayed online may occasionally be unavailable due to simultaneous in-store or online purchases, inventory discrepancies, damage, or other circumstances.

We reserve the right to limit quantities, discontinue products, correct inventory errors, or cancel an order if an item is unavailable.

If we are unable to fulfill an order for an item you have already paid for, we will refund the amount paid for the unavailable item.

3. Product Images and Condition

Product photographs may sometimes be stock images or representative images rather than photographs of the exact item being purchased unless otherwise stated.

For pre-owned, vintage, collectible, or otherwise individually conditioned merchandise, actual condition may vary from a stock or representative image.

Trading card condition is identified using the condition assigned to the item at the time of listing. Because grading and condition assessment may contain an element of subjectivity, customers purchasing in store are encouraged to inspect higher-value items before completing their purchase.

Pre-owned video games, consoles, controllers, and electronics may exhibit normal signs of age and previous use, including scratches, discoloration, label wear, cosmetic damage, or other age-related characteristics.

4. Vintage and Pre-Owned Electronics

Video games, consoles, controllers, and other pre-owned electronics sold by Treasure Chest Games are tested in-house before being offered for sale unless specifically stated otherwise.

These items are sold as-is and without an ongoing warranty unless a specific written warranty is expressly provided with the item.

Many of these products are decades old. Testing an item before sale confirms its functionality at the time it is tested but does not guarantee how long the item or any of its components will continue to function.

Customers purchasing or picking up these products in store may request that a staff member demonstrate the item's functionality before completing the purchase or leaving the store.

A vintage or pre-owned product that was functioning as represented when sold but later stops functioning due to age, wear, deterioration, component failure, misuse, accidental damage, or other subsequent causes is not eligible for a refund or replacement solely because of that later failure.

5. Pricing

Prices for products are subject to change without notice.

Collectible products, including trading cards, sealed products, video games, and other merchandise, may increase or decrease in market value after purchase. Changes in market value do not qualify an order for cancellation, return, refund, price adjustment, or store credit.

We make reasonable efforts to ensure that prices displayed on our website are accurate. However, typographical errors, inventory synchronization errors, technical errors, or incorrect pricing may occasionally occur.

We reserve the right to correct pricing errors and cancel an order placed for an item that was clearly or materially mispriced. If payment has already been collected for an order we cancel because of a pricing error, the amount paid for the cancelled item will be refunded.

6. Orders

Placing an order does not necessarily guarantee acceptance or fulfillment of that order.

We reserve the right to refuse or cancel an order for reasons including, but not limited to:

• Product unavailability

• Inventory discrepancies

• Pricing or listing errors

• Suspected fraudulent activity

• Payment problems

• Violation of purchase limits

• Abuse of promotions or discounts

• Resale restrictions associated with certain products or organized play programs

• Other circumstances that reasonably prevent us from completing the transaction

If we cancel an order after payment has been collected, we will refund the applicable amount.

7. Final Sale Merchandise

Due to the nature of the merchandise we sell, many or all products may be designated Final Sale.

This includes certain trading cards, sealed trading card products, collectibles, pre-owned merchandise, vintage merchandise, limited-release products, event registrations, preorders, and other products as identified by Treasure Chest Games.

Final Sale items are not eligible for return or exchange due to buyer's remorse, purchasing the wrong product, changes in market value, or a change of mind.

Our complete rules regarding returns, damaged items, incorrect orders, and products that were not functioning as represented are contained in our Return & Refund Policy, which is incorporated into these Terms of Service.

8. Preorders

Products offered for preorder may have estimated or announced release dates provided by publishers, manufacturers, or distributors.

These dates may change for reasons outside the control of Treasure Chest Games.

Unless otherwise stated, preorders are considered final sale. A publisher, manufacturer, distributor, or release-date delay does not automatically entitle the customer to cancel or receive a refund for a preorder.

We reserve the right to establish purchase limits on highly allocated or limited products.

If we are unable to obtain sufficient inventory to fulfill a preorder, we may cancel and refund the affected order.

9. Event Registrations

Registration for tournaments, prereleases, leagues, and other events may be subject to separate event-specific rules.

Unless otherwise stated, event registrations are final sale.

Purchasing registration does not exempt a participant from store rules, tournament rules, organized play requirements, age restrictions, eligibility requirements, or applicable publisher policies.

We reserve the right to remove a participant from an event or our premises for disruptive, unsafe, abusive, fraudulent, or otherwise inappropriate conduct.

10. In-Store Pickup

Customers selecting in-store pickup are responsible for reviewing their order when collecting it.

For tested video games, consoles, controllers, electronics, or similar merchandise, customers may request a demonstration of functionality before leaving the store.

Once merchandise has been picked up, our Return & Refund Policy applies.

11. Shipping

Shipping times shown on our website or provided by shipping carriers are estimates and are not guaranteed unless explicitly stated otherwise.

Once a package has been transferred to a shipping carrier, delays caused by the carrier, weather, transportation disruptions, customs processing, incorrect customer information, or other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address.

12. Payment Information

You agree to provide current, complete, and accurate purchase and account information for transactions made through our store.

Payments may be processed by Shopify or other third-party payment providers. Your use of those payment services may also be subject to the applicable provider's terms and privacy policies.

We do not guarantee that every payment method will be available for every transaction or product.

13. Promotions, Discounts, Store Credit, and Loyalty Rewards

Promotional offers, coupon codes, discounts, store credit, loyalty rewards, and other incentives may be subject to additional restrictions.

Unless otherwise stated:

• Promotions cannot be combined with other offers.

• Promotions have no cash value.

• Loyalty rewards and promotional credits are not redeemable for cash.

• Eligibility may be limited to specific products, collections, customers, dates, or sales channels.

• We may correct or reverse rewards or credits issued as the result of fraud, abuse, technical errors, or transaction reversals.

We reserve the right to modify or discontinue promotional or loyalty programs, subject to applicable law.

14. Third-Party Services and Links

Our website may contain links to third-party websites or use services provided by third parties, including payment processors, shipping providers, social media platforms, product integrations, and other service providers.

We are not responsible for the content, availability, practices, or policies of independent third-party websites or services.

Vintage, collectible, and pre-owned merchandise is inherently subject to age, wear, deterioration, and variations in condition.

To the fullest extent permitted by applicable law, Treasure Chest Games LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of our website, products, or services.
